Better Wine for Texas

Tuesday, April 17th, 2012

If you aren’t a big wine dinker you might not be familiar with the Draconian wine shipping laws which pervade the United States. The story is actually pretty simple, after Prohibition ended the federal government didn’t want to be responsible for the governing of alcohol laws.  Commerce Clause in the Constitution be damned, they allowed every state to create their own alcohol regulations.  As it turns out, some like to grant easy access to permits while others would prefer to enlist entitlement programs for local businesses.  It is interesting that states which espounge the free market like Texas currently bar out of state retailers from shipping into the state….that is unless you’re sufficiently big enough, then they’re willing to cut a side deal with you.  Free market, who needs it right?
